Couch White has experience in structuring borrowing, debt financing, including facilities financing and mortgages, lines of credit, debt collection, construction and commercial contracts, employee contracts, energy performance contracts and bankruptcy prevention and resolution.

The Firm’s representative experience includes:

• Contract negotiation and review for not-for-profit entities including loans to and from clients.
• Representation of not-for-profit lenders on underwriting loans to tax-exempt entities, and understanding governance, and compliance, risks of lending to not-for-profits.
• Counselling not-for-profit organizations regarding compliance with, and operating under, loan covenants, collateral, governance and refinancing restrictions and maintenance of debt service reserves.
• Representation of creditors of not-for-profit entities including structuring of payments in conformity with debtor cash flow and expenses.
• Act as borrower’s counsel in review of tax-exempt bond and other facility financing documentation and counsel including the formation of “Friends Of” tax-exempt financing vehicles, lease-backs and securing lenders’ permission / waiver in existing contracts.
