As part of the Fiscal Year 2020-21 New York State Enacted Budget, lawmakers passed legislation which will expand prevailing wage requirements beyond public works projects to include some private projects as well – a first in the State’s history. The law, which becomes effective January 1, 2022, will apply to projects totaling $5,000,000 and where the project receives 30% or more of its total construction costs from public funds. This law will result in an increase in the number of construction projects that will become subject to prevailing wage requirements. This article discusses the prevailing wage legislation.
