On March 11, 2022, the U.S. Department of Labor (DOL) announced the publication of the proposed rule, “Updating the Davis-Bacon and Related Acts Regulations.” DOL Secretary Marty Walsh said that the Wage and Hour Division plans to carry out the “most comprehensive” reform of the Davis-Bacon Act in decades, changing the law that governs prevailing wages on public works projects. The DOL proposes to amend regulations including adding new anti-retaliation provisions and revised cross-withholding procedure for recovering back wages including cross-withholding for back wages owed on contracts held by different but “related” legal entities.
