Couch White Partner Leonard Singer recently obtained an Order from the New York State Public Service Commission allowing its client to continue to own and develop electric generation projects while also owning and operating an electric transmission project. The transmission project is an approximately 20-mile 345 kilovolt (kV) electric transmission facility in Western New York that Len had previously obtained a Certificate of Environmental Compatibility and Public Need for under Article VII of the NY Public Service Law. In the subsequent order, the Commission found that its Vertical Market Power Policy Statement does not preclude ownership of both generation and transmission projects based on the facts established at an evidentiary hearing.
